Please read these Terms of Use (“Terms”) carefully. They govern your access to and use of the website at burstynlaw.com and any associated pages (the “Site”), which is operated by Burstyn Law, PLLC, a Florida professional limited liability company (“Burstyn Law,” the “Firm,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, please do not use the Site.

No Attorney–Client Relationship

Your use of the Site does not create an attorney–client relationship between you and Burstyn Law, and nothing on the Site is an offer to represent you. An attorney–client relationship with the Firm is formed only when (a) you and the Firm have signed a written engagement agreement, and (b) the Firm has completed its conflict-of-interest review and confirmed the engagement in writing. Sending us an email, completing the contact form, or otherwise communicating through the Site does not, by itself, make you a client, obligate the Firm to represent you, or obligate the Firm to keep your communication confidential.

Do Not Send Confidential or Time-Sensitive Information

Please do not send us confidential, privileged, or sensitive information through the Site, by email, or through the contact form until an attorney–client relationship has been established in writing. Because no such relationship exists at the inquiry stage:

  • Information you submit before an engagement is not treated as confidential or privileged and may not be protected by the attorney–client privilege or the rules of professional responsibility;
  • Submitting information to the Firm does not preclude the Firm from representing another client adverse to you, including in a matter related to your inquiry; and
  • We cannot guarantee the security of information transmitted over the internet.

Do not rely on the Site to convey anything time-sensitive. If you have an urgent matter or a filing deadline, contact a lawyer directly by telephone. The Firm has no obligation to monitor, respond to, or act on unsolicited communications.

Attorney Advertising

To the extent required by the rules of professional conduct of any jurisdiction, including the Rules Regulating The Florida Bar, this Site may be considered attorney advertising. The hiring of a lawyer is an important decision that should not be based solely on advertisements or other promotional material.

No Guarantee of Results; Prior Results

Descriptions of the Firm’s experience, representative matters, recoveries, rulings, recognitions, and results reflect past events and the particular facts and circumstances of those matters. Prior results do not guarantee or predict a similar outcome in any future matter. Every case is different, and the outcome of any matter depends on its own facts, the applicable law, and many factors outside the Firm’s control. Any references to verdicts, settlements, awards, rankings, or honors are provided for informational purposes and are not a promise or guarantee regarding the outcome of your matter.

Where We Practice; Authorized Jurisdictions

Burstyn Law is based in Miami, Florida. The Firm’s attorneys are licensed to practice law only in the jurisdictions identified in their individual biographies on the Site. The Firm does not seek to represent anyone, and does not hold its attorneys out as qualified to practice law, in any jurisdiction where the Site or its content would not comply with that jurisdiction’s laws or rules of professional conduct. Nothing on the Site should be construed as the practice of law in, or the solicitation of clients in, any jurisdiction where any attorney of the Firm is not authorized to practice. Matters requiring representation in a jurisdiction where the Firm is not admitted may be handled with appropriately licensed local counsel or declined.

Permitted Use of the Site

Subject to these Terms, the Firm grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Site for your own informational, non-commercial use. You agree not to:

  • use the Site in any way that violates any applicable law or regulation, or any rule of professional conduct;
  • copy, reproduce, republish, frame, scrape, harvest, or redistribute any part of the Site except as expressly permitted by these Terms or applicable law;
  • attempt to gain unauthorized access to the Site, its servers, or any associated systems, or interfere with or disrupt the integrity or performance of the Site;
  • introduce any virus, malware, or other harmful code, or use any robot, spider, or automated means to access the Site without our prior written consent;
  • submit false, misleading, or fraudulent information, or impersonate any person or entity; or
  • use any contact information on the Site to send unsolicited communications, advertising, or solicitations.

Intellectual Property

The Site and all of its contents — including text, graphics, logos, the Firm name and marks, photographs, images, page layout, design, and the selection and arrangement of materials (collectively, the “Content”) — are owned by or licensed to Burstyn Law and are protected by United States and international copyright, trademark, and other intellectual property laws. Except for the limited license in Section 7, no right, title, or interest in any Content is transferred to you. “Burstyn Law” and the Firm’s logo are marks of the Firm and may not be used without our prior written permission.

Submissions Through the Site

If you submit information, messages, or files to the Firm through the Site (a “Submission”), you represent that you have the right to provide it and that it does not infringe the rights of, or violate any obligation owed to, any third party. Subject to Section 3 and our Privacy Policy, you grant the Firm the right to retain and use your Submission to respond to your inquiry, to perform conflict-of-interest checks, to maintain records, to operate and secure the Site, and to comply with our legal and professional obligations. Do not upload confidential, privileged, or sensitive documents through the Site’s file-upload feature. Uploaded files are stored with our service providers and may be accessible to anyone who obtains the file’s link; the upload feature is intended only for non-confidential materials, such as a copy of a publicly filed document.

No Warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, THE FIRM DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

The Firm does not warrant that the Site will be uninterrupted, secure, error-free, or free of viruses or other harmful components, or that any information on the Site is accurate, complete, or current. The Firm may modify, suspend, or discontinue the Site, in whole or in part, at any time without notice.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL BURSTYN LAW OR ITS MEMBERS, ATTORNEYS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO USE, THE SITE OR ITS CONTENT, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Nothing in these Terms limits any liability that cannot be limited or excluded under applicable law, and this Section does not apply to the Firm’s obligations to its clients under a signed engagement agreement.

Indemnification

You agree to indemnify and hold harmless Burstyn Law and its members, attorneys, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your misuse of the Site or your breach of these Terms.

Governing Law and Venue

These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. You agree that the exclusive venue for any such dispute will be the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts. This Section governs disputes about the Site only; it does not govern the engagement terms between the Firm and its clients, which are set out in a separate written agreement.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Changes are effective when posted. Your continued use of the Site after we post changes means you accept the revised Terms.

Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and the Firm regarding the Site and supersede any prior understanding on that subject. You may not assign these Terms; we may.
